Resale Under Construction Flat in Gurgaon: How Transfer Works in a Sold-Out Project

📂 Investment Guide | 📅 21 Oct 2026

Buying a resale under-construction flat in Gurgaon means taking over an existing allotment, not purchasing a registered property. The developer endorses the allotment letter and builder-buyer agreement in your name once dues are cleared and the transfer fee set by that agreement is paid. Under Section 2(d) of the RERA Act, 2016, anyone who acquires an allotment through sale or transfer is also an allottee, so delay interest and refund rights move with the unit. You deduct 1 percent TDS when the price is ₹50 lakh or more.

Resale Units in Sold Out Gurgaon Projects

DLF announced on 4 October 2026 that all 172 homes at The Aureva in Sector 63 had sold for about ₹1,985 crore. The Aureva is a G+45-floor senior living tower with 4 BHK residences, and the developer now has no units left to book.

Buyers who still want to buy a unit in a sold-out project in Gurgaon have one route: purchasing an existing allottee's position. That position is an allotment plus a payment history, not a title, so each step goes through the developer's transfer desk until the conveyance deed is signed.

Builder Endorsement Process in Haryana

Builder endorsement in Haryana is the developer's written record that the allotment now stands in the new buyer's name. Gurgaon developers follow this broad sequence:

The seller asks the developer for a statement of account confirming paid and pending instalments.

Seller and buyer sign an agreement to sell recording the price, the amount already paid to the developer and who meets future demands.

Both parties file the developer's transfer application with identity proofs, affidavits and indemnities, and pay the transfer fee.

The developer endorses the allotment letter and agreement, or issues a fresh allotment, and sends later demand letters to the buyer.

The buyer pays the seller's balance after deducting tax and files the TDS statement.

Transfer Charges for Resale Flats in Gurgaon

Transfer charges for resale flats in Gurgaon are a contractual fee set by the transfer clause in each developer's sale agreement, so the amount varies by developer and sometimes by phase. The RERA Act has no transfer fee schedule, so the signed agreement determines the bill.

The same clause also states whether transfer is allowed before a set share of the price is paid and whether the developer may withhold consent. Ask the seller for the complete signed agreement and read these terms before you pay any token amount.

Documents Required for Transfer of Flat in Gurgaon

Allotment letter and the agreement for sale or builder-buyer agreement

Payment receipts from the developer, matched against the seller's bank statement

NOC from builder for resale, showing nil overdue amounts

Earlier endorsement letters, if the unit has changed hands before

Lender's closure letter or written consent, if the seller financed the unit

Seller's PAN and identity proof for the tax deduction and the developer's file

Project registration and quarterly progress updates appear on the Haryana RERA portal, and our guide on checking RERA and property legal status explains that search step by step.

RERA Rights of Subsequent Allottee in Haryana

Delay interest under the proviso to Section 18(1) of the RERA Act is payable for every month of delay to an allottee who stays in the project. HARERA Gurugram computes it at the State Bank of India marginal cost of lending rate plus 2 percent under Rule 15 of the Haryana rules.

Section 19 of the Act lists further rights of an allottee, including information on sanctioned plans and a refund with interest when the promoter fails to deliver. A transferee inherits the possession date written in the original agreement and does not get a fresh deadline.

Stamp Duty on Resale of Under Construction Flat in Haryana

Stamp duty on resale of an under-construction flat in Haryana is linked to the registered conveyance deed, which the promoter must execute in the allottee's favour within 3 months of the occupancy certificate, unless local law sets a different period. Because the endorsed buyer is the allottee on record by then, the deed is registered in that buyer's name.

Current Haryana duty rates, registration fees and other add-ons are covered in our breakdown of hidden costs of luxury flats in Gurgaon, so budget for them when you agree the resale price.

Home Loan for Resale Under Construction Property

A home loan on an endorsed unit requires the developer's permission to mortgage, and most lenders also require a tripartite agreement signed by the buyer, the bank, and the developer. If the seller's bank signed such an agreement, it can restrict transfer of the allotment without that bank's consent.

Time the sanction so that disbursement matches the endorsement date and the developer's next demand. BharatAcre's home loan team can line up the lender's legal check with the transfer paperwork.

TDS on Purchase of Resale Property and Seller Capital Gains

Since 1 October 2024, the TDS threshold is tested on the total consideration where a unit has several buyers or sellers, so a smaller individual share in a joint deal still needs deduction. The Income-tax Act, 2025 replaced the 1961 law from 1 April 2026 and keeps this deduction for property purchases.

For the seller, gains on an allotment held for more than 24 months are long-term and taxed at 12.5 percent. Reinvesting the proceeds in another residential house can reduce that tax.

HARERA Gurugram Orders on Endorsed Units

We reviewed recent HARERA Gurugram orders involving endorsed units before writing this guide. In a 2025 order on a Sector 70 commercial project, the complainant had bought from the original allottee in 2018, and the Authority still counted delay interest from the due date in the original agreement until a valid offer of possession plus 2 months.

That same order refused claims raised after the conveyance deed, other than statutory benefits, so a resale buyer should file any delay claim before signing the conveyance. Our desk also read the Supreme Court ruling of 22 July 2021 on subsequent purchasers, which held that a transferee's relief depends on the facts and allowed 9 percent interest on refund from the date the builder learnt of the transfer.

Your endorsement date is your legal start line. Get it on the developer's letterhead before you pay the seller in full.

Resale Flat Transfer FAQs

Can I buy a flat from the original allottee before possession in Gurgaon

You can buy it before possession by taking over the original allottee's allotment through a developer endorsement. The seller signs an agreement to sell with you, the developer approves the transfer under its builder-buyer agreement, and your name replaces the seller's on the allotment letter. You then pay all remaining instalments directly to the developer.

Is builder permission required to transfer an under-construction flat?

You need the developer's written consent because the allotment is a contract with the developer, not a registered title the seller can pass on alone. Without endorsement, the developer will continue to treat the seller as the allottee. Our legal services team can review the transfer clause and the seller's file before you sign anything.

Can a builder refuse to transfer an allotted flat

You may face refusal or delay if the seller has overdue instalments, a lender's charge on the unit, or an agreement that restricts transfer until a set payment stage. Clearing dues and obtaining the bank's written consent usually address these objections. If transfer is permitted and the developer still blocks it, you can complain to HARERA Gurugram.

Who pays the builder's transfer charge in a resale deal

You and the seller decide who pays this charge, because the developer only needs the amount cleared before it endorses the unit. The fee can be split, deducted from the sale price, or paid separately by either side. Record the agreed payer, amount, and payment date in your agreement to sell, and attach the developer's fee demand letter.

What happens to the payment plan after transfer of allotment

You step into the seller's payment plan exactly as it stands, including the instalment stages, interest on late payment, and any discount terms already agreed. The developer does not reset the schedule for you. Ask for an updated statement of account in your name immediately after endorsement so every future demand letter reaches you directly.

Where can I find resale flats in under-construction projects in Gurgaon

You can find resale allotments through existing allottees, channel partners who sold the launch, and property platforms listing secondary inventory. Shortlist only units where the seller can show the full developer file. Browse current options across Golf Course Extension Road, Dwarka Expressway and Southern Peripheral Road on our Gurugram property page.
